Please read these Terms of Use ("Terms") carefully before using our mobile application, NotebookGPT (the "App").

1. Acceptance of Terms By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you are not permitted to use the App.

2. Account Registration To use certain features of the App, you must create an account and provide a valid email address. You are responsible for the accuracy and currency of your account information. You are also responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

3. Subscriptions and Credits Access to the advanced features of the App is provided through paid subscription plans.

• Credit System: Based on the subscription plan you purchase, a specific amount of "credits" will be added to your account at the beginning of each subscription period. These credits are used to access the AI-based features within the App.
• Credit Renewal and Use: At the beginning of each subscription period, the credit amount defined in your plan is automatically added to your account. Unused credits from the previous subscription period do not roll over, accumulate, or get added to the credits of the next period. When your subscription renews, your credit amount is also renewed from scratch.

4. License and Use We grant you a non-transferable, non-exclusive, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms. You agree not to:

• Use the App for any unlawful, misleading, or unauthorized purpose.
• Create or disseminate content that promotes hate speech, harassment, or illegal activities.
• Reverse engineer, decompile, disassemble, or attempt to create derivative works from the App's source code.
• Take any action that could interfere with the proper working of the App or its associated servers and networks, or negatively affect other users' experience.
• Upload viruses, spyware, or other malicious code.

5. Third-Party Services Our App uses third-party services to provide its functionality, such as AssemblyAI (for speech-to-text conversion) and OpenAI (for AI-based chat and analysis). By using these services, you also agree to the terms of use and privacy policies of the respective third parties. You acknowledge that we have no control over and are not responsible for the content, policies, or practices of these third-party services.

6. Intellectual Property The App and its original content, features, and functionality (including but not limited to the logo, design, text, and graphics) are our property and are protected by international copyright, trademark, and other intellectual property laws. The ownership of the content you create, such as notes and voice recordings, belongs to you. However, when you process this content with AI features, you grant us and our third-party service providers the necessary license to perform that action.

7. Disclaimer of Warranties The App is provided to you "AS IS" and "AS AVAILABLE." We make no warranties, express or implied, that the App or the AI-generated content will be accurate, reliable, uninterrupted, or error-free. You acknowledge that responses provided by the AI are for informational purposes only and do not constitute professional advice.

8. Limitation of Liability To the maximum extent permitted by law, in no event shall we, our directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, loss of profit, or other intangible losses) arising from your use or inability to use the App.

9. Termination We reserve the right to suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

10. Changes to These Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Your continued use of our App after any changes become effective constitutes your acceptance of the new terms.
